We are committed to protecting the privacy of our website visitors, customers, and other stakeholders. This Privacy Notice explains how we treat your personal information.
- What we need? Processed personal data
Our company, THERMACUT, k.s. with its registered office at Sokolovská 574, Mařatice, Uherské Hradiště (the Czech Republic), Id. No. 46963715 is the controller of the personal data you (as the data subject) provide to us. In case you enter into a contractual relationship, communicate or apply for a job with any of our subsidiaries in other countries, the controller is the respective subsidiary (see the list of our subsidiaries under “Contact us”).
THERMACUT, k.s. is the controller of all personal data processed via the website www.thermacut.com incl. data processed based on cookies (for more information about cookies, see this link).
Any processing of personal data is always tied to the intended purpose and this purpose corresponds to the relevant legal title of processing within the meaning of Article 6 of the General Regulation on Personal Data Protection (GDPR), in particular: performance of the contract/negotiation of the contract, fulfillment of legal obligations of the controller, consent of a data subject or legitimate interests of the controller.
We collect the following types of personal information from you:

a) Customers: gender, first name and last name, job title, company address, e-mail address, VAT number, Identification No., direct office and/ or telephone number, bank account number.
b) Transactions with customers: any transactions and correspondence carried out between you and us as customer or other relation, including information relating to any purchases you make of our goods or services.
c) Job seekers: first name and last name, e-mail address, telephone number, information about education, professional development, specialization, skills, language skills, information published on applicant’s LinkedIn / jobs.cz profile (if you connect with us or have a public profile) and further personal data provided by a job seeker.
d) Suppliers: gender, first name and last name, job title, company address, e-mail address, VAT number, Identification No., direct office and/ or telephone number, bank account number, any transactions and correspondence carried out between you and us as supplier.
● Website:
a) contact form: information that you provide to us by filling in forms for information requests which includes: first name and last name, e-mail address, telephone number, company name, company country, message (open field),
b) newsletter registration: e-mail address, information based on mailing profiling and campaigns.
c) complaint form: e-mail address, company name, contact person, additional information regarding complaints and technical questions.
d) service form: e-mail address, company name, contact person, additional information regarding service / purchase questions and requests.
e) information about your visits to and use of this website, such as your IP-address, geographical location, browser type, referral source, length of visit and number of page views.
All the procedures and measures taken by our company, adopted, and implemented in this area, are consistently based upon current legislation regarding the protection of personal data and privacy, in particular:
- ● Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (further on just “Regulation”)
- ● Adaptation of the legislation of the Czech Republic, as well as
- ● Civil Code, No. 89/2012 Coll., and Act No. 480/2004 Coll., on certain Information Society Services
In the event of any changes to the legislation in question, those procedures and measures shall continue to conform to legal regulations and changes.
- What we do with it? Data transfer and third-party
Your personal data will be processed by THERMACUT, k.s., located in the Czech Republic and they are processed in EU. If there is a reason for transfer of data to the third countries (for instance based on a business relationship concluded by you), you will be informed about data transfer to the respective country.

If you provide us with your personal data in connection with our offer of goods and services and we further process the collected data, we become the personal data controller responsible for the proper processing and protection of such data.
No third-party providers have access to your data, unless we need to disclose information about you reasonably necessary:
a) to the extent that we are required to do so by law or a contract,
b) in connection with any legal proceedings or prospective legal proceedings,
c) in order to establish, exercise or defend our legal rights (including providing information to others for the purposes of fraud prevention and reducing credit risk).
- Why we need it? Purpose and legal title for personal data processing
We need to collect, store and use your personal data based on the following legal titles and purposes:
NEWSLETTERS & MARKETING:
Data processing is based on you consent or our legitimate interest.
○ Collecting email for the purpose of sending you: (a) information that we think may be of interest to you; or (b) marketing communications (newsletters) we think may be of interest to you. We can send you newsletters base on your explicit consent, e.g. via our website, or you already are a client of ours from whom we have obtained an email address in connection with business relationship with us, in which case we may send you commercial communications relating to these or similar services even without your prior request or consent, in accordance with Act 480/2004 Sb., on certain information society services (so-called direct marketing based on legitimate interest).
BUSINESS:
Data processing is based on contract, laws or our legitimate interest.
○ Information about your name, e-mail address and direct telephone number, as the contact person of our customer or other relationship, doing business with us by negotiation or on the basis of a settled agreement, for the purpose of discussing, agreeing, considering and consulting on ongoing issues, as well as for tax and accounting purposes based on the relevant laws or for defense of our legal claims and interests.
JOB SEEKERS:
Data processing is based on contract/negotiation of contract or your consent.
○ Information you provide as a job seeker we use for the purposes of the selection procedure, assessing a candidate’s suitability for a particular position and afterwards for preparation of employment agreement. If you give a consent via application of jobs.cz we can keep your CV in our database and contact, you in the event we consider you to be a suitable candidate for another position in our company.
COMMUNICATION:
Data processing is based on our legitimate interest or contract.
○ Information you provide to us by (1) filling out the contact form /service form / complaint form on this website or (2) providing us with a business card or (3) other communication for the purpose of requesting information or exercise of contractual rights.
WEBSITE:
Data processing is based on our legitimate interest or your consent.
○ Collecting information about your computer and your visits to and use of this site to improve the user experience, for marketing purposes, and to recognize your computer when you visit our site and to customize the site for you (please see the information about cookies).
- How long we keep it? Data storage expiration
We retain your data for the time necessary for processing for the relevant purpose. We store your personal data for the duration of the contract, after which it is retained for the limited period for the defense of our legal claims and, to the extent necessary for the performance of our legal obligations under tax and accounting regulations for the period specified in these regulations (i.e., up to ten years).
Personal data used for sending newsletters and mailing campaigns are kept until your consent is withdrawn. In case newsletters are sent to customers without their prior consent (see above), the data retention period is 24 months after the termination of our relationship.
Personal data of job seekers are processed until the end of the selection procedure, or up to 3 years for the consent to the storage of CVs granted via jobs.cz.
After this period, your personal information will be irreversibly destroyed.
- What are your rights?
In the case of THERMACUT® processing your personal data as the Administrator, you are in the legal position of the data subject who has all rights against the administrator, under the General Data Protection Regulation.
As a data subject you have the following rights towards the data controller, within the meaning of Articles 15 to 22 of the Regulation:
- ● the right of access to personal data, in particular the right to request information from the controller about the processing of your personal data;
- ● the right to correct personal data if the data is inaccurate;
- ● the right to delete personal data (the “right to be forgotten“);
- ● the right to limit the processing of personal data;
- ● the right to object to the Controller processing your personal data. You may also object at any time if your personal data is processed for direct marketing purposes (including profiling).
- ● the right to data portability, where we provide your personal data that are being processed under a contract or on the basis of consent to a third party, provided that this is permitted by law and is technically feasible;
- ● the right to withdraw your consent with data processing (for example a consent with sending newsletters);
- ● the right not to be subject to automated individual decision-making, including profiling (with exceptions).

- Security of your personal data
In any processing of your personal data, we place an emphasis on effective protection against leakage or misuse, in particular through the necessary technical measures and security of our site and other information systems and SW applications that we use, as well as through binding internal procedures and organizational rules for processing personal data including the duty of confidentiality from our employees.
In this regard, our company has also issued the Directive on the processing and protection of personal data at THERMACUT® and has adopted specific technical, organizational, and other measures to ensure protection of both automated and manually processed personal data.
In specific cases, further processing of personal data may be entrusted to another person – the personal data processor – and this processing is regulated in detail by a contract for the processing of personal data which, according to the General Regulation of Personal Data Protection, provides strict technical and organizational rules for effective protection of data processed by the processor.
